An Ocala Social Security Disability Attorney Discusses Events After Your Hearing

In this article, an Ocala Social Security disability attorney sheds light on the events that transpire once the hearing has ended and you have received the decision.

The Decision

Regardless of whether or not the decision is in your favor, contact your Ocala Social Security disability lawyer immediately once you receive your copy of the decision to be certain that he or she has been sent a copy also. Copies are normally sent simultaneously to you and your attorney, but errors can occur. By ascertaining that there has been no mistake and that your attorney has his or her copy of the decision, you ensure that your lawyer is fully informed of events in the case, whether or not any mistakes have been made in the decision and whether or not an appeal is in order if the decision was negative. You will also ensure that your attorney is in a position to oversee any benefits that are to be paid to you.

If The Decision Is Negative

As difficult as it is to understand, there are times when even deserving cases receive a denial. If this happens to you, you should contact your Ocala Social Security disability lawyer right away to determine the likelihood and advisability of appealing the decision. Time is of the essence here, as your lawyer must file the appeal within 60 days of the decision. The documents must be submitted to the Appeals Counsel before that deadline is reached or the opportunity for appealing your case will be lost.

Fees And Expenses

Depending on the terms of the fee agreement you have with your attorney, the amount due to your lawyer will be retained by the SSA and disbursed to him upon confirmation that neither you nor the judge have any disagreement with the total. This can amount to 25 percent of back benefits but cannot exceed the $6,000 limit presently put into effect by the Commissioner of Social Security. Since SSA withholds this you are not billed directly for it although the funds are, in fact, yours. You may; however, be liable for other expenses if it is required by your attorney’s fee agreement.
